ASSUMPTION OF RISK, WAIVER OF LIABILITY,  AND AUTHORIZATION TO CONTACT:

To the fullest extent permitted by law, I, {name},  hereby acknowledge and agree to the following:

(1) Assumption of Risk. Use of any facilities, services, equipment or premises at a fitness club (collectively, "Facilities") involves risks of injury to my person and property and to the person or property of any minor for whom I have guardianship and have requested or allowed entry to or use of such a club (including the use of "Kids Klub" services) (a "Minor"); by engaging in such use, or by permitting such use by a Minor, I voluntarily accept and assume full responsibility for such risks.

(2) Waiver of Liability. Spartans Fitness Center, LLC, its successors, and their respective directors, officers, members, managers, employees, volunteers, independent contractors, and agents (collectively."FI") will not be liable for any injury to my person or property or to the person or property of any Minor. On behalf of myself, my heirs (including any Minors).-personal representatives and assigns, I hereby release, discharge and hold harmless F1 from any and all liability and claims arising from my use, or any Minot's use, of the Facilities, including, but not limited to, all liability and claims arising from personal injury (including death), accidents or illness, and damage to, loss of, or theft of property, whether caused by the active or passive negligence of FI, and I covenant not to sue Fl with respect to, and I waive any and all claims that I may have now or in the future against Fl for, any liability arising from my use, or any Minor's use, of the Facilities.

(3) Authorization to Contact. By providing my phone number or e-mail address, I authorize the operator of this club or its affiliates to contact me regarding promotions or special events, regardless of whether I am on a Do Not Call registry.

I further understand and agree that I may not use any of the Facilities at this club unless I am an authorized guest of either a member or a permitted vendor. or unless specifically authorized by club staff. Some restrictions on my ability to use the Facilities may apply.

If any provision above is null, void or unenforceable under applicable law, it shall be deemed omitted and shall not apply, but the other provisions above shall remain in effect.

By signing below, I, {name}, authorize Spartans Fitness Center to charge my provided payment method for the agreed membership fee on a recurring basis. I understand that my membership renews automatically unless canceled through the member portal. I acknowledge that I may cancel my membership at any time, but there are no refunds for payments already processed. My membership will remain active through the paid period.

I also agree to a 24 hours notice of cancellation.  I agree to incur any charges because of lack there of.

For good and valuable consideration, the receipt of which is hereby acknowledged, I,
, hereby grant Spartans Fitness Center permission to use my likeness in a photograph in any and all of its publications, including but not limited to all of Spartans Fitness Center 's printed and digital publications. I understand and agree that any photograph using my likeness will become property of Spartans Fitness Center and will not be returned.
I acknowledge that since my participation with Spartans Fitness Center is voluntary, I will receive no financial compensation.
I hereby irrevocably authorize Spartans Fitness Center to edit, alter, copy, exhibit, publish or distribute this photo for purposes of publicizing Spartans Fitness Center 's programs or for any other related, lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph.
I hereby hold harmless and release and forever discharge Spartans Fitness Center from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

Gym Membership Agreement

This Gym Membership Agreement is entered into as of {Date} by and between Spartans Fitness Center LLC located at 5650 St Court, Naples, FL 43110, and {Member’s Full Name}, residing at {Member Address}.

1. Membership Terms 1.1. The Member agrees to join Spartans Fitness Center LLC under a 6-month membership plan, beginning on {Start Date} and ending on {End Date} ("Initial Term"). 1.2. This Agreement will automatically renew for subsequent 6-month periods ("Renewal Term") unless canceled in accordance with Section 3 below.

2. Membership Fees 2.1. The Member agrees to pay the following fees:

   2.2. The Member agrees to pay a total membership fee of ${Total Amount} for the Initial Term, payable monthly, as selected by the Member upon signing this Agreement. 2.3. Spartans Fitness Center LLC reserves the right to adjust membership fees for Renewal Terms upon providing the Member with at least 30 days' written notice. 2.4. If the Member wishes to cancel their membership before the end of the Initial Term, they must pay the total remaining amount due for the duration of the contract. 2.5. The Member authorizes Spartans Fitness Center LLC to electronically transfer funds (EFT) from their designated bank account or credit card for all membership fees and associated charges. This authorization remains in effect until the Member provides written notice of cancellation in accordance with this Agreement. 2.6. A late fee of $5 will be charged for each week that a payment is missed.

3. Membership Renewal and Cancellation 3.1. This Agreement will automatically renew unless the Member provides written notice of cancellation at least 5 business days prior to the end of the Initial Term or any Renewal Term. 3.2. Written cancellation notices must be delivered in person at Spartans Fitness Center LLC during the manager's business hours. 3.3. If the Member fails to provide timely cancellation notice, the membership will renew automatically, and the Member will be obligated to pay for the Renewal Term.

4. Member Responsibilities 4.1. The Member agrees to abide by all Spartans Fitness Center LLC rules, regulations, and policies, which may be updated from time to time at Spartans Fitness Center LLC’s discretion. 4.2. The Member is responsible for informing Spartans Fitness Center LLC of any changes to their contact information, including address, phone number, and email address. 4.3. The Member must notify their trainer at least 24 hours in advance to cancel or reschedule a training session. Failure to provide such notice or failure to show up for the session without notice will result in the Member being charged for the session. 4.4. The Member is liable for any damage caused to Spartans Fitness Center LLC property and agrees to pay for any repairs or replacements resulting from such damage. 4.5. In the event that the Member’s assigned trainer resigns or is terminated, the Member’s contract shall remain in effect, and Spartans Fitness Center LLC will assign the Member to a new trainer.

5. Trainer Resignation or Termination 5.1. If the Member’s assigned trainer resigns or is terminated from Spartans Fitness Center LLC, the Member is still obligated to complete the terms of this Agreement and continue their membership through the remaining term. 5.2. In such cases, Spartans Fitness Center LLC will assign a new trainer to the Member, and the Member agrees to work with the newly assigned trainer. Spartans Fitness Center LLC will make reasonable efforts to match the Member with a trainer of similar qualifications and availability. 5.3. The Member acknowledges that no reduction in membership fees will occur due to a change in trainer.

6. Termination by Spartans Fitness Center LLC 6.1. Spartans Fitness Center LLC reserves the right to terminate this Agreement immediately if the Member violates any terms of this Agreement or Spartans Fitness Center LLC’s rules. 6.2. Upon termination, the Member forfeits any prepaid fees for the remaining period of the membership.

7. Liability Waiver 7.1. The Member acknowledges that the use of Spartans Fitness Center LLC’s facilities and participation in activities involves inherent risks, including the risk of injury. 7.2. The Member agrees to release and hold harmless Spartans Fitness Center LLC, its owners, employees, and agents from any claims or liabilities arising out of or related to the Member’s use of the Gym facilities.

8. Health and Safety Statement 8.1. The Member affirms that they are in good physical health and capable of using Spartans Fitness Center LLC’s equipment and facilities. If the Member has any medical conditions or physical limitations, they agree to consult with a healthcare professional before using the facilities. 8.2. Spartans Fitness Center LLC recommends that the Member undergo a physical examination by a physician prior to using the facilities, especially if they have any medical concerns or have not exercised regularly.

9. Suspension of Membership 9.1. The Member may request a temporary suspension of their membership for medical reasons, travel, or other extenuating circumstances. Such requests must be made in writing to Spartans Fitness Center LLC and accompanied by appropriate documentation (e.g., medical note or travel itinerary). 9.2. If Spartans Fitness Center LLC approves the suspension, the Member’s membership fees will be suspended for the duration of the approved period, and the membership term will be extended accordingly. 9.3. Suspensions are subject to approval at Spartans Fitness Center LLC's discretion and may not exceed {Insert Maximum Time Period, e.g., 3 months}.

10. Use of Remaining Sessions After Cancellation 10.1. If the Member cancels their membership, they are allowed to use any remaining paid-for training sessions within one month after the cancellation date. 10.2. After one month, any unused sessions will expire and cannot be refunded or transferred. 10.3. The Member must schedule and complete all remaining sessions within this one-month period or forfeit any remaining sessions.

11. Entire Agreement 11.1. This Agreement constitutes the entire agreement between the Member and Spartans Fitness Center LLC and supersedes all prior understandings or agreements, whether written or oral, relating to the subject matter herein.

12. Governing Law 12.1. This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

By signing below, the Member acknowledges that they have read, understood, and agree to the terms of this Agreement.
