ASSUMPTION OF RISK, WAIVER OF LIABILITY,  AND AUTHORIZATION TO CONTACT:

(1) Assumption of Risk . Use of any facilities, services, equipment or premises at a fitness club (collectively, "Facilities") involves risks of injury to my person and property and to the person or property of any minor for whom I have guardianship and have requested or allowed entry to or use of such a club (including the use of "Kids Klub" services) (a "Minor"); by engaging in such use, or by permitting such use by a Minor, I voluntarily accept and assume full responsibility for such risks.

(2) Waiver of Liability. Spartans Fitness Center, LLC, its successors, and their respective directors, officers, members, managers, employees, volunteers, independent contractors, and agents (collectively."FI") will not be liable for any injury to my person or property or to the person or property of any Minor. On behalf of myself, my heirs (including any Minors).-personal representatives and assigns, I hereby release, discharge and hold harmless F1 from any and all liability and claims arising from my use, or any Minot's use, of the Facilities, including, but not limited to, all liability and claims arising from personal injury (including death), accidents or illness, and damage to, loss of, or theft of property, whether caused by the active or passive negligence of FI, and I covenant not to sue Fl with respect to, and I waive any and all claims that I may have now or in the future against Fl for, any liability arising from my use, or any Minor's use, of the Facilities.

(3) Authorization to Contact. By providing my phone number or e-mail address, I authorize the operator of this club or its affiliates to contact me regarding promotions or special events, regardless of whether I am on a Do Not Call registry.

I further understand and agree that I may not use any of the Facilities at this club unless I am an authorized guest of either a member or a permitted vendor. or unless specifically authorized by club staff. Some restrictions on my ability to use the Facilities may apply.

If any provision above is null, void or unenforceable under applicable law, it shall be deemed omitted and shall not apply, but the other provisions above shall remain in effect.

Membership Authorization and Cancellation Policy

By signing below, I, {name}, authorize Spartans Fitness Center to charge my provided payment method for the agreed membership fee on a recurring basis. I understand that my membership renews automatically unless canceled in accordance with the terms outlined below. I acknowledge that I may cancel my membership at any time; after the inicial term however, there are no refunds for payments already processed, and my membership will remain active through the paid period.

I understand and agree to the following terms:

• This agreement is for a 6 -month membership term, beginning on the date of signature.

• Cancellations must be made in person at Spartans Fitness Center during general manager business hours (Monday–Friday, 10:00 AM – 6:00 PM).

• Cancellations are only permitted if the contract is out of term, meaning the full 6-month commitment has been completed.

• If I choose to cancel before the end of the 6 -month term, I am responsible for paying the remaining balance of the contract in full at the time of cancellation.

• minimum of thirty (30) days’ written notice in person its required for any cancellation. I agree to incur any charges that result from failure to comply with this notice requirement.

I understand and agree that any photograph using my likeness will become property of Spartans Fitness Center and will not be returned.
I acknowledge that since my participation with Spartans Fitness Center is voluntary, I will receive no financial compensation.
I hereby irrevocably authorize Spartans Fitness Center to edit, alter, copy, exhibit, publish or distribute this photo for purposes of publicizing Spartans Fitness Center 's programs or for any other related, lawful purpose. In addition, I waive the right to inspect or approve the finished product, including written or electronic copy, wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of the photograph.
I hereby hold harmless and release and forever discharge Spartans Fitness Center from all claims, demands, and causes of action which I, my heirs, representatives, executors, administrators, or any other persons acting on my behalf or on behalf of my estate have or may have by reason of this authorization.

Membership Agreement

This Gym Membership Agreement is entered into as of {sign_date}, by and between Spartans Fitness Center LLC, located at 5650 St Court, Naples, FL 43110, and {name} residing at {address}

1. Membership Terms

1.1. The Member agrees to join Spartans Fitness Center LLC under {membership_duration} plan, beginning on {sign_date} and ending on {expiration_date} ("Initial Term"), as selected at the time of signing.

1.2. Automatic Renewal
This Agreement will automatically renew for successive 6-month terms unless the Member initiates the cancellation process prior to the end of the current term. To prevent renewal, the Member must complete the cancellation process in person during general manager business hours before the renewal date. If no cancellation is made, the contract will renew automatically under the same terms and conditions.

1.3. Renewal of the membership is required to maintain the initial membership rate. Failure to renew may result in a rate increase based on the current pricing at the time of renewal.

2. Membership Fees

2.1. The Member agrees to pay the following fees at the start of the membership:

2.3. Spartans Fitness Center LLC reserves the right to adjust membership fees for Renewal Terms with 30 days' written notice.

2.4. If the Member cancels before the end of the Initial Term, they must pay the total remaining amount due under the contract.

2.5. The Member authorizes Spartans Fitness Center LLC to electronically transfer funds (EFT) from their bank account or credit card for all fees and charges.

2.6. A $25 late fee will be charged for each missed or declined payment not resolved within 3 days of the due date.

3. Membership Renewal and Cancellation

3.1 If the member wishes to cancel their contract prior to the agreed-upon end date, they are required to pay the remaining balance of the contract in full at the time of cancellation.

3.2. This Agreement will automatically renew. 

3.3. Cancellation must be done in person at Spartans Fitness Center LLC and must be submitted directly to the gym manager during business hours.

3.5 To cancel this membership, the Member must provide a minimum of thirty (30) days’ written notice in person prior to the cancellation date. This notice must be submitted during the manager’s business hours.

3.6 If the member fails to provide the required thirty (30) days’ notice, the member agrees to pay the remaining amount due in the contract before the cancellation can be completed.

3.7 Cancellations requested outside of this process or timeframe will not be honored.

3.8 Relocation or Closure Policy:
In the event that Spartans Fitness Center LLC closes or relocates, the Member's membership will be transferred to the nearest available location within 30 miles of the previous location. This Agreement will remain valid at the new location under the same terms and conditions.
If the new location is within the 30-mile range but the Member chooses to cancel instead of transferring, the Member is still responsible for paying the total remaining balance on the membership contract.

4. Member Responsibilities

4.1. The Member agrees to follow all gym rules, policies, and instructions.

4.2. The Member must notify Spartans Fitness Center LLC of changes to their contact information.

4.3. The Member must provide 24 hours' notice to cancel or reschedule training sessions; otherwise, they will be charged for the missed session.

4.4. The Member is responsible for damages they cause to gym property.

4.5. If a trainer is reassigned, the Member must continue their contract with a new trainer.

5. Trainer Resignation or Termination

5.1. If a trainer leaves the gym, the Member must continue their membership.

5.2. A new trainer will be assigned, and Spartans Fitness Center LLC will make a reasonable match.

5.3. No fee reductions will be issued due to trainer changes.

6. Termination by Spartans Fitness Center LLC

6.1. Spartans Fitness Center LLC may terminate this Agreement for violations of the terms or rules.

6.2. If terminated by the gym, the Member forfeits any prepaid fees.

7. Liability Waiver

7.1. The Member understands that use of the facilities involves risks, including injury.

7.2. The Member releases Spartans Fitness Center LLC and its employees from liability related to facility use.

8. Health and Safety Statement

8.1. The Member affirms they are in good health and able to exercise.

8.2. A physician's exam is recommended, especially if the Member has health concerns.

9. Suspension of Membership

9.1. Members may request a suspension for medical or travel reasons with written documentation.

9.2. If approved, payments will pause and the term will extend accordingly.

9.3. Suspensions may not exceed 3 months and are subject to gym approval.

10. Use of Remaining Sessions After Cancellation

10.1. After cancellation, the Member may use remaining paid-for sessions within one month.

10.2. Unused sessions after that time expire and are non-refundable.

10.3. Sessions must be completed within that one-month window.

11. Entire Agreement

11.1. This document is the entire agreement and supersedes all prior terms or discussions.

12. Governing Law

12.1. This Agreement is governed by the laws of the State of Florida.

13. Guest Policy

13.1. Members are not permitted to bring guests or non-members into Spartans Fitness Center LLC facilities without prior written approval from gym management.

13.2. Unauthorized guests may be asked to leave the premises immediately.

13.3. Members are responsible for any damage or incidents caused by their guests.

14. Membership Non-Transferability

14.1. Memberships are strictly personal and non-transferable. Members may not transfer or assign their membership, rights, or privileges under this Agreement to another person.

15. Refund Policy

15.1. Membership fees are non-refundable, except in cases of gym closure, relocation without acceptable alternatives, or approved medical suspensions.

15.2. Requests for refunds must be submitted in writing and are subject to management approval.

16. Privacy Policy

16.1. Spartans Fitness Center LLC respects the privacy of its Members and will protect all personal information collected.

16.2. Personal data will be used only for membership administration and communication purposes and will not be shared with third parties without consent, except as required by law.

17. Force Majeure

17.1. Spartans Fitness Center LLC shall not be liable for failure or delay in performance of its obligations under this Agreement due to events beyond its reasonable control, including but not limited to natural disasters, government restrictions, or pandemics.

18. Photo and Video Release

18.1. Members agree that Spartans Fitness Center LLC may take photos or videos on premises for promotional and marketing purposes unless the Member submits a written request to opt-out.

19. Use of Equipment and Facility Rules

19.1. Members agree to use equipment properly and safely as instructed by trainers or staff.

19.2. Children under the age of {Insert Age, e.g., 16} must be accompanied by an adult.

19.3. The gym reserves the right to restrict access to any Member violating safety rules or policies.
